''Persistent'' security worker fails to have appeal heard

A security agent failed on five separate occasions to gain permission to challenge the decision that he was fairly dismissed by his employer, it has been reported.

ICTS employee Mr Djedje was sacked from his role at Heathrow Airport after stealing an ice-cream, a decision that was subsequently upheld by a Reading employment tribunal, reports emplaw.co.uk.

Following the ruling, he made continued attempts to have an appeal heard despite there being no contentious point of law on which to focus a challenge upon.

The case eventually reached the Court of Appeal, where LJ Rimer reinforced the four previous decisions to deny a right to appeal.

He stated: "I too am of the opinion that his challenge to the decision of the employment tribunal raises no arguable points of law that have any reasonable prospect of success.

"Mr Djedje''s challenge to the fairness of his dismissal is groundless. I refuse his application, which I regard as without merit."

Employers must be able to identify a valid reason for dismissing staff members and prove they "acted reasonably in the circumstances".
